Article 3 – Applicability
These Terms & Conditions apply to all offers made through Kavanagh & Lane and to all orders and distance contracts concluded between us and the Consumer.
Before completing an order, the Consumer will be given the opportunity to review these Terms & Conditions electronically.
By placing an order through our Site, you acknowledge that you have read and accepted the Terms & Conditions applicable to your purchase.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Article 4 – Our Offers
We aim to describe and display our products as accurately as reasonably possible.
Product descriptions, specifications, images, colours, sizes, and other information are provided to help you make an informed purchasing decision. Colours and appearance may vary slightly depending on your device, screen settings, or other factors.
Obvious errors, typographical mistakes, or clearly incorrect prices do not bind us. If we discover an error affecting an order, we may contact you to provide the correct information and, where appropriate, give you the option to confirm or cancel the order.
Any conditions or limitations that apply to a particular offer will be clearly stated alongside that offer.
Article 5 – Formation of the Contract
A contract is formed when you submit an order, the payment is successfully authorised, and we accept the order.
After placing an order, you will normally receive an electronic order confirmation.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment issues, obvious pricing errors, incorrect product information, or lack of product availability.
If we cancel an order after payment has been received, the relevant amount will be refunded to the original payment method.
Article 6 – Right of Withdrawal
Consumers have the right to withdraw from eligible purchases within 14 days without giving a reason.
The withdrawal period begins on the day after you, or a third party designated by you other than the carrier, receive the goods.
To exercise your right of withdrawal, you must inform us within the 14-day withdrawal period by contacting:
After informing us of your decision to withdraw, you have an additional 14 days to return the goods.
During the withdrawal period, you may inspect and handle the product only to the extent reasonably necessary to establish its nature, characteristics, and functionality.
If a product has been handled beyond what is reasonably necessary and its value has been reduced as a result, we may make an appropriate deduction from the refund where permitted by applicable law.
For complete return instructions, please refer to our Returns & Cancellation Policy.
Article 7 – Return Costs and Refunds
Unless otherwise required by applicable consumer law, the Consumer is responsible for the direct cost of returning a product when exercising the right of withdrawal.
Because our supplier and return facility may be located outside your country, international return shipping costs may apply. The applicable return address and instructions are provided in our Returns & Cancellation Policy.
We will process eligible refunds within the legally required period. We may withhold reimbursement until we have received the returned goods or you have provided evidence that the goods have been sent back, whichever occurs first.
Refunds are issued to the original payment method unless otherwise agreed.
Where required by applicable consumer law, standard outbound delivery charges paid as part of the original purchase will also be refunded. Additional charges for express or premium delivery options are not refundable.
Article 8 – Exceptions to the Right of Withdrawal
The right of withdrawal may not apply to certain products or services where an exception is permitted under applicable consumer law.
Examples may include:
-
Products made to the Consumer's specifications or clearly personalised
-
Goods that deteriorate or expire rapidly
-
Sealed goods that are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery
-
Sealed audio, video, or software products where the seal has been broken
-
Other products or services specifically excluded from the statutory right of withdrawal
Where an exception applies, this will be communicated where required before the purchase is completed.
Article 9 – Prices, Taxes and Import Charges
The price shown on the product page at the time of purchase is the price applicable to the order, subject to obvious pricing or typographical errors.
Products may be shipped directly from our suppliers and distribution partners located outside the destination country.
Depending on the destination and applicable tax and customs regulations, import VAT, customs duties, clearance fees, or other import-related charges may be payable upon importation.
Where these taxes or charges are not collected by us at checkout, they may be collected separately from the recipient by the postal service, courier, customs authority, or another party involved in the import process.
Any applicable import charges that are not included or collected at checkout are the responsibility of the recipient.
All prices and charges displayed during checkout are subject to the applicable tax and customs rules for the destination of the order.
Article 10 – Product Conformity and Consumer Rights
We are responsible for supplying products that conform to the contract and meet the requirements imposed by applicable consumer law.
Any commercial or manufacturer's warranty offered with a product is additional to, and does not limit, your statutory consumer rights.
If you receive a product that is damaged, defective, incorrect, or otherwise does not conform to your order, please contact us at:
Please include your order number and, where relevant, photographs or other information that helps us assess the issue.
Your statutory rights regarding defective or non-conforming products are not affected by these Terms & Conditions.
Article 11 – Delivery
We take reasonable care when processing and fulfilling orders.
Orders are typically processed and dispatched from the distribution centre within 48 hours.
After dispatch, delivery typically takes 7–10 business days.
Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, including carrier delays, customs processing, public holidays, severe weather, or unusually high order volumes.
If we are unable to fulfil your order, we will contact you and, where appropriate, provide a refund.
The risk of loss or damage to the goods remains with us until the goods are delivered to you or to a third party designated by you, other than the carrier, in accordance with applicable consumer law.
Article 12 – Payment
Payment must be made using one of the payment methods available at checkout.
You are responsible for providing complete and accurate billing and payment information.
Payments may be processed by third-party payment service providers. We do not necessarily receive or store your complete credit card details.
We may delay, refuse, or cancel an order where a payment cannot be authorised or where we reasonably suspect fraudulent or unauthorised activity.
Article 13 – Complaints
If you have a complaint regarding your order, product, delivery, or our service, please contact us at:
Please provide your order number and a clear description of the issue so that our customer service team can investigate it efficiently.
We aim to respond to customer enquiries within 48 hours. More complex complaints may require additional time to investigate, in which case we will keep you informed where appropriate.
Submitting a complaint does not affect any statutory rights available to you under applicable consumer law.
Article 14 – Privacy
Personal information provided when using our Site or placing an order is handled in accordance with our Privacy Policy and applicable data protection legislation.
Please refer to our Privacy Policy for more information about how we collect, use, store, and share personal information.
Article 15 – Governing Law and Consumer Rights
These Terms & Conditions and contracts entered into through Kavanagh & Lane are governed by the laws applicable to VB Digital in the Netherlands.
However, if you are a Consumer residing in another country, nothing in these Terms & Conditions deprives you of any mandatory consumer protections that apply to you under the laws of your country of residence.
Any dispute will be handled in accordance with applicable law and the mandatory jurisdiction rules protecting Consumers.
Article 16 – Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, services, or applicable laws and regulations.
The Terms & Conditions applicable to your order are those in effect at the time your order is placed.
